General conditions of use and sale of the e1talency.com website

Preamble 

These general conditions of use are  concluded between:

- the manager of the website, hereinafter referred to as "  the Editor  »,

- anyone wishing to access the site and its services, hereinafter called "  the user  ".

 

Article 1 - Principles

These general conditions of use  are intended to provide a legal framework for the use and sale of the Site  e1talency.com  and its Services.

Definitions  :

 

User Company  : designates any legal person, using the Site for strictly professional purposes with the aim of sharing its needs for interim services, recruitment, wage portage.

 

Service provider  : designates any natural or legal person, either having a SIRET number and registered in the Trade and Companies Register, the Directory of Trades, the Maison des Artistes, the Agessa, having the status of micro-entrepreneur or exercising as a self-employed person under legal conditions which offers its services to User Companies through the Site.

 

Site  : refers to the website whose address is www.e1talency.com .

 

Services  : designates all the services provided by the company on the Site and in particular, the service of connection between Service Providers and User Companies, the services of provision of means of payment tools, the establishment and issuance of invoices for the accounts of the Service Providers.

 

Benefits  : refers to the services provided by the Service Provider whose need has been expressed by a User Company on the Site.

 

Users  : designates the User Companies and the Service Providers.

 

Invoicing Mandate  : designates the invoicing mandate concluded between the Service Provider and the Company under the terms of which the Service Provider agrees to entrust the Company, in compliance with the applicable rules, with the establishment and issuance of invoices relating to the Services provided.

 

The general conditions of use must be accepted by any User, and his access to the site constitutes acceptance of these conditions.

 

Section 2  - Evolution and duration of the T&Cs

These general conditions of use are concluded for an indefinite period.  The contract takes effect with regard to the User from the start of the use of the service.

The Site  reserves the right to modify the clauses of these general conditions of use at any time and without justification.

 

Article 3 - Access to the site

Any User with access to  internet can access the site for free and from anywhere  e1talency.com. The costs incurred by the User to access it (internet connection, computer equipment, etc.) are not borne by the Publisher.

The site and its various services may be interrupted or suspended by the Publisher, in particular during maintenance, without obligation of notice or justification.

The Site User  has access to the following services:  Online market place dedicated to bringing together Human Resources Service Providers and "user" Companies.

The site includes a member area reserved for registered users. These users will be able to access it using their login credentials. 

The services reserved for members are as follows: 

  • Submission of need(s) on the platform for User Companies,

  • Consultation of current needs for Service Providers,

  • Provision of means of payment intended to secure the service,

  • The establishment and issuance of commercial proposals in the name and on behalf of the Service Providers,

  • The establishment and issuance of invoices relating to the missions carried out, in the name and on behalf of the Service Providers.

 

Section 4  - Responsibilities 

The responsibility of the Publisher cannot be engaged in the event of failure(s), breakdown(s), difficulty(s) or interruption(s) of operation, preventing access to the site or to one of its functionalities.

The connection equipment used to go to the combli.com site  is the sole responsibility of the User, who must take all appropriate measures to protect the  material and its  data, including virus attacks via the Internet. 

The user is  moreover the sole responsible for the sites and data that he consults.

 

The Publisher cannot be held responsible in the event of legal proceedings against the User.  :

-   due to the use of the site or any service accessible  via  Internet  ;

-   due to non-compliance by the User  of these general conditions.

 

The Publisher is not responsible for damage caused to the User, to third parties and/or to the User's equipment as a result of its  connection or sound  use of the site, and the User  give up  to any action against the Publisher  thereby.

If the Publisher were to be the subject of an amicable or legal procedure for  use of the site by  the User, it could turn against him  to obtain compensation for all damages, sums, convictions and costs that may arise from this procedure.

 

The User is allowed  to publish on the Site  :

- comments ;

- texts ;

-  User companies can publish requirements.

The user  undertakes to make statements respectful of others and of the law and accepts that its publications be moderated or refused by the Publisher, without obligation of justification. 

By publishing on the site, the User assigns to the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, distribute and distribute its publication, directly or through an authorized third party.

However, the Publisher undertakes to cite the member in the event of use of his publication.

 

 

 

Clause 5 –  Price

The Service Provider pays a commission to the Company, calculated on the basis of a percentage of the total value of the invoices issued via the Site.

The Price of Services (excluding options) is set at  :

  • 10% for recruitment services,

  • 5% for wage portage services,

  • 3% for interim office services.

These amounts are fixed in relation to the amount excluding VAT of the price of the Service.

Article 6 - Payment system 

Payment by the User Company is made by payment of invoices issued by e1talency.com on behalf of third parties (the Service Provider). Payment is made from 30 or 45 days after issue of the invoice according to the conditions set by the Service Provider.

 

For the purposes of implementing the payment system, the Company has subscribed to the services of BNP PARIBAS.

 

Article 7 - Intellectual property

All technical documents, products, photographs, texts, logos, drawings, videos, etc.,  are subject to copyright and are protected by the Intellectual Property Code.  When they are  given to our customers, they remain the exclusive property of  E1 TALENCY, the sole holder of the intellectual property rights to these documents, which must be returned to it at its request.

Our customers undertake not to make any use of these documents that may infringe the industrial or intellectual property rights of the supplier and undertake not to disclose them to any third party, except with express and prior authorization given by the Editor.

 

Article 8 - Hypertext links

The implementation by the User  of any hypertext link to all or part of the site is strictly prohibited, except with the prior written authorization of the Publisher, requested by email at the following address  :  talency@e1.com.

The Publisher is free to refuse this authorization without having to justify its decision in any way whatsoever. In the event that the Publisher grants its authorization, this is in any case only temporary and may be withdrawn at any time, without obligation of justification at the Publisher's expense.

In all cases, any link must be removed at the Publisher's request.

Any accessible information  via  a link to other sites is not under the control of the Publisher, which declines all responsibility for their content.

 

Section 9  - Protection of personal data

The user undertakes to make fair use of the Site, in particular not to circumvent the Site and its Services.

The User Company undertakes to propose a serious and sufficiently detailed need for a Service.

 

The Service Provider undertakes not to approach User Companies by offering them commercial relations outside the Platform for any need disseminated.

 

The Service Provider undertakes not to enter into contact, by e-mail or telephone, with a user company without the prior written authorization of the Site.

 

The Service Provider undertakes to maintain strict confidentiality in the exchanges  that he would have had with User Companies and to the information that would have been transmitted to him or of which he would have knowledge during contact via the Site (whether or not giving rise to a commercial relationship).

Article 11 - Cookies

The website  e1telency.com  may automatically collect standard information. Any information collected indirectly will only be used to track the volume, type and pattern of traffic using this site, to develop its design and layout and for other administrative and planning purposes and more generally to improve the service offered.  

 

Section 12  - Applicable law

These general conditions of use are subject to the application of French law. 

If the parties fail to resolve a  dispute  out of court, the dispute will be subject to the jurisdiction of the French courts.
